Terms of Service

1. A free beta

HeyBiscuit is in beta and currently free. Features may change, break or go away, and we may limit or end the beta. If we ever introduce paid plans, we'll tell you first, and nothing will be charged without your clear agreement.

2. Who can use it

You must be at least 18 years old (or the age of majority where you live) to create an account. Parents and guardians may add their own children to the family calendar, but children may not create their own accounts, and we don't knowingly collect personal information from children under 13 except what a parent or guardian enters about their own kids (see our Privacy Policy). You're responsible for the people you invite to your family and for what you let them see.

3. Your account

Keep your sign-in methods secure and tell us at george@estuarysystems.ai if you think someone else has accessed your account. You're responsible for activity under your account.

4. Your content

You own what you put into HeyBiscuit: family details, schedules, recordings, photos and messages. You give us permission to store, process and display that content only as needed to run HeyBiscuit for you and the people you share with, including sending it to our service providers (such as our AI provider) to perform the features you use. Our Privacy Policy explains how we handle it.

Only add information about other people (including family members) that you have the right to share, and only upload photos and recordings you have the right to use.

5. Acceptable use

Please don't:

• break the law, or use HeyBiscuit to harass, stalk or harm anyone;
• try to access other families' data, or test, probe or disrupt the service without our permission;
• send spam through invites, texts or emails;
• copy, resell or reverse engineer the service.

We may suspend or close accounts that break these rules.

6. AI features

Biscuit uses AI to turn what you say into calendar items, answer questions and make avatars. AI can make mistakes, so you review suggested changes before they're saved. Please double-check anything important, such as dates, times, medication or allergy details, and who's driving.

7. Texts, emails and notifications

If you turn on text alerts, the daily digest or emails, we'll send messages to the number or address you give us. Message and data rates may apply. Reply STOP to any text to opt out, or change your settings in Profile → Notifications.

8. Not for emergencies

HeyBiscuit is a convenience tool. Don't rely on it for emergencies, medical decisions or anything where a missed reminder could cause serious harm.

9. Ending your use

You can stop using HeyBiscuit at any time and delete your account in Profile → Account & sign-in → Delete my account. We may end or suspend your access if you break these terms or if we shut down the beta, and we'll give reasonable notice when we can so you can save what you need.

10. Disclaimers

HeyBiscuit is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't promise the service will be uninterrupted, error-free or that data will never be lost, so keep your own copies of anything important.

11. Limitation of liability

To the fullest extent the law allows, Estuary Systems LLC won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or missed events, arising from your use of HeyBiscuit. Because the beta is free, our total liability for any claim is limited to US $50.

12. Changes to these terms

We may update these terms. We'll change the date at the top and, for significant changes, tell you in the app or by email. Continuing to use HeyBiscuit after changes take effect means you accept them.

13. General

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute arising from these terms or HeyBiscuit will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you and we consent to their jurisdiction. If any part is found unenforceable, the rest still applies. These terms and the Privacy Policy are the whole agreement between you and us about HeyBiscuit.
